Another Sunset Review for the Board
The Texas Medical Board (which also includes the Physician Assistant, Acupuncture, and Surgical Assistant Board) will undergo a “special purpose” review for the 81st Legislatative Session in 2009. The past legislature passed this request at the last day of the session due to concerns expressed by some regarding the Board.
The two general purposes of the review are:
1. An evaluation of the Board’s management efforts to comply with the legislature’s directives, and;
2. Any recommendations the commission considers appropriate based on a review of the Board.
In 2008, the Sunset Commission will review the Board and take public comment regarding the Board. Its report should be completed just prior to the start of the session. The report should have findings and recommendations.
Those interested in this process should contact the Sunset Commission.

Jon, the TMB seems to be taking a little heat lately with the legislative hearing and the call to have Kalufut and Robinson removed. Have you any information about this? Secondly, do you know if the board met this last week of November?
Guy Fogel MD
Sorry for the delay in the response. It is without question that the
Board has taken some heat over the last few months. There as been a
somewhat organized effort against the agency for what some believe are
overly harsh tactics and questionable use of due process. Much of the
attacks are directed at the President of the Board, Dr. Kalufut, the
Executive Director, Dr. Patrick, and the Director of Enforcement Ms.
Robinson. There is a great deal of information regarding these attacks. The
best place to hear the concerns is the the House hearing on October
23rd. The full hearing, which is over 11 hours, can be found on the
House’s website under the appropriations committee. The Board did meet both
November 29th and 30th in Austin. The agenda for the meeting in on
the Board’s website. Minutes will be posted in the future.
